MONTGOMERY COUNTY, TX – Kherkher Garcia, LLP filed a case in Harris County on behalf of five passengers involved in a fatal boating incident on Lake Conroe last weekend.

On August 14th, 2021, 53 passengers boarded the Lake Conroe Queen, a 60-passenger sternwheeler paddleboat operated by 1097 Water Sports, Inc. for a sunset cruise. 

Despite repeated warnings about inclement weather, including heavy thunderstorms and winds in the area, the defendants decided to set sail anyway. At about 8:00 p.m., the winds increased significantly, creating five-to-six-foot waves. 

Shortly thereafter, the Lake Conroe Queen capsized near Regency Point. 

When the boat overturned, diesel fuel began to leak into the lake. Passengers started frantically attempting to escape the sinking vessel as life vests floated away in the contaminated water. Heroic bystanders and neighbors in the area immediately sprung into action, pulling the boat’s passengers to shore. Local agencies, including the Conroe Fire Department,  Montgomery County Constable’s Precinct 1, and the Montgomery Fire Department, also assisted in the rescue.

Three passengers were rushed to nearby hospitals in serious condition. A fourth victim was pronounced dead at the hospital.
