Biography

Eric A. Hawley primarily handles commercial litigation and catastrophic personal injury matters.

Mr. Hawley manages a wide variety of commercial cases, representing both plaintiffs and defendants involved in complex business litigation. He represents a diverse group of clients, which include executives, investors, small business owners, and large international corporations. Mr. Hawley has represented clients at each stage of litigation, from the pre-petition negotiations all the way through the verdict at trial and post-judgment. Mr. Hawley also has assisted with representation through the appeals process.

Additionally, Mr. Hawley advises clients on a broad range of catastrophic and serious personal injury matters, including negligence, wrongful death, and premises liability, among others.

Originally from Dallas, Texas, Mr. Hawley graduated from the University of Texas at Austin with a Bachelor of Arts in History in 2005. After working for a year in Houston, Mr. Hawley returned to the University of Texas for law school as a recipient of the Tom C. Clark Fellows Scholarship in Law.

While at The University of Texas School of Law, Mr. Hawley was the Recent Developments Associate Editor for the Texas Journal of Oil, Gas & Energy Law. He participated in the Capital Punishment Clinic as a Student Attorney, assisting with the representation of indigent defendants charged with or convicted of capital offenses. During law school, Mr. Hawley worked for non-profit organizations, including the Texas Legal Services Center where he aided victims of identity theft, and the Texas Center for Policy Studies where he worked to effect change in environmental policy in Texas.

After graduating from the University of Texas School of Law in 2010, Mr. Hawley began practicing law at Schwartz, Junell, Greenberg & Oathout, L.L.P., where he counseled various clients in business and commercial litigation, as well as employment and labor litigation. Mr. Hawley also gained experience advising clients on compensation issues such as wage & hour compliance and overtime requirements under the Fair Labor Standards Act.

In 2014, Mr. Hawley joined Jesus Garcia at Tucker, Barnes, Garcia & de la Garza, LLP where he continued his practice of commercial litigation and began representing plaintiffs who suffered serious personal injuries. Mr. Hawley continued working with Mr. Garcia over the next several years and eventually joined him in founding Kherkher Garcia, LLP.

Representative Cases:

Commercial Litigation:

  • Following a trial by jury, Eric Hawley and Jesus Garcia Jr. obtained a unanimous verdict and judgment on behalf of their Client against defendants for breach of contract, recovering the full amount of contract damages, including the recovery of all attorney's fees sought.
  • Represented a manufacturer of oil field equipment in its recovery of $8,000,000.00 even though the manufacturer was named as defendant in the lawsuit. When a dispute arose between the Client and its distributor, the distributor filed suit against the Client alleging that the Client was cheating the distributor out of millions of dollars by selling its equipment in breach of the agreement and intentionally hurting the distributor’s business. Eric Hawley and Jesus Garcia fired back with counterclaims against the distributor for breach of contract and fraud. At the end, they prevailed and recovered $8,000,000.00 for the Client.
  • Following a two-day hearing and presentation of evidence, Eric Hawley and Jesus Garcia successfully defended several businesses against a temporary injunction, which would have cost the Clients millions in halted sales had it been granted. On appeal, Mr. Hawley drafted significant portions of the brief that persuaded the appellate court to affirm the trial court’s decision without the need for oral argument.
  • Represented an anesthesiologist against his former employer in a lawsuit for breach of contract and obtained a final judgment for the full amount of contract damages, plus attorney’s fees, and obtained sanctions against the opposing party that included monetary fees and a striking of all counterclaims.
  • Represented an individual against his former employer claiming unpaid wages and breach of contract and successfully obtained all amounts demanded from the employer without ever having to file suit.
  • Represented a midstream oil and gas company against an exploration company for breach of contract and obtained a substantial but confidential monetary settlement for the client.
  • Represented a dozen international clients who were sued for various business torts and obtained dismissal of all claims for lack of personal jurisdiction.
  • Represented an individual employee named as a defendant in a suit regarding intellectual property and obtained a dismissal of all claims against the client for lack of personal jurisdiction.
  • Worked with a team of lawyers in defending a national electrical infrastructure company in an out-of-state mass tort action involving over a billion dollars in damage claims, which resulted in a confidential settlement.
  • Personal Injury:

  • Represented the family of a painter who lost his life while on the job at an auto body shop and assisted in obtaining a substantial but confidential monetary settlement.
  • Represented the family of a demolition worker who lost his life while on the job and assisted in obtaining a substantial but confidential monetary settlement.
  • Represented a man who suffered severe electrical burns to his body due to faulty equipment at a job site and assisted in obtaining a substantial but confidential monetary settlement.
  • Represented a man who suffered personal injuries when an elevator failed and fell suddenly and obtained a favorable confidential monetary settlement.
  • Represented and obtained settlements on behalf of many drivers, passengers, pedestrians, and others in Texas who suffered personal injuries as a result of motor vehicle collisions caused by the negligence of other drivers.
